東京都受動喫煙防止条例（仮称）の基本的な考え方へのパブリックコメント ― 2017/09/23
東京都が、受動喫煙防止条例（仮称）の基本的な考え方について、パブリックコメントを募集しています。
期日は10月6日まで。JTなどのタバコ業界から猛烈な反対コメントが予想されているので、この法案が骨抜きや廃案にされないよう、賛成意見の人もコメントをお願いします。メールフォームからコメント投稿可能。都外の方も投稿可能です。
コメント投稿に必要な情報は都道府県か市町村名と年代及び性別だけなので、個人情報の心配なく投稿できます。（投稿後は確認手段がないので、投稿確認の画面をスクリーンショットしておくことをお勧めします）
どんなことを投稿してよいかよくわからない人は、 「99.その他」に、「受動喫煙防止に賛成で、この内容が後退することなく成立することを希望します」だけでも良いと思います。
考え方についてちょっと意見を書いてみた。抜け穴を塞ぐ感じの意見ですが。
３．定義について
受動喫煙の定義について、「他人が発生させるたばこの煙又はたばこを吸っている他人の呼気に含まれる煙にさらされること」とあるが、この定義では煙の出ないタバコが抜け穴とされるかもしれない。
実際問題となっているのはタバコに含まれる有害物質なので、ここは「他人が発生させるたばこの"有害化学物質"又はたばこを吸っている他人の呼気に含まれる"有害化学物質"にさらされること」としたほうがより良いのではないだろうか。
三次喫煙（過去に喫煙されたことのある場所に立ち入ったときに、壁などに残留・付着している有害化学物質により被害を受けること）も防止するのにも有効になると思う。
６．喫煙禁止場所の除外
家庭内の喫煙が禁止されていないが、乳幼児がいる住宅においては禁止するべき。児童虐待に含めてしまえばここで規制しなくても良いのかもしれないけど。
問題なのはアパートや住宅街の場合で、隣の家に乳幼児が居る場合か。ベランダで吸うと隣の家にも煙が入る。 このあたりは近所づきあいの範疇になるんだろうな。
１１．施設等の管理者に求めること
喫煙所を設ける場合、道路（特に信号のある交差点）に面した場所に設けることは禁止してほしい。 あと、喫煙室の排気が通行人にかからないようにすることを義務付けてほしい。
そうしないと、信号待ちの歩行者が受動喫煙することになり意味が無くなってしまう。今もそういうところが多い。コンビニとか飲食店の喫煙室の排気とか。
設置許可される喫煙室が、煙草の煙を完全に分解するような浄化装置があるものに限られるなら良いのだが、実際は価格とかも高くて飲食店が設置するのは難しいだろうし。
今のところ思ったのはこれくらい。 また追記するかも。
